Terms of Service

The short version

  • fallo emails your new YouTube videos and live streams to fans who asked for them. It’s free for now.
  • Fans must sign up themselves and confirm by email. No bought, rented or scraped lists, ever.
  • Your fan list is yours to download, but use it only to send fans what they signed up for: your videos and channel content.
  • fallo can hold videos that look like scams, and pause or close accounts that send spam or break these terms.
  • By using the YouTube features you also agree to the YouTube Terms of Service.
  • fallo is provided as it is. Our Privacy Policy explains what we do with personal information.

About these terms

These terms are an agreement between you and [Company legal name], [registered address] (“fallo”, “we”, “us”), for using fallo.ai and its emails, API and integrations (the “service”). By creating an account or using fallo, you agree to them. If you use fallo for a business or organisation, you agree on its behalf.

The Privacy Policy is part of these terms.

What fallo does

fallo lets YouTubers and online content creators (“creators”) collect the email addresses of people who want their videos (“fans”), and then emails those fans each new video and live stream. It includes a fan page at fallo.ai/yourname, QR codes, share links, recommendations between creators, fan rewards, stats, a CSV download, an API and webhooks.

We may change, add or remove features over time.

Your account

  • You must be at least [minimum age, e.g. 18] (or the age of majority where you live) to create an account.
  • Give us accurate details and keep your email address up to date: it’s how we reach you about your account.
  • Keep your password and API keys safe. You’re responsible for what happens under your account and keys. Tell us straight away if you think someone else has used them.
  • One person or organisation per account. Don’t create accounts to get around limits or a suspension.

YouTube and Google

fallo uses YouTube API Services. By using fallo’s YouTube features, you agree to be bound by the YouTube Terms of Service. Google’s handling of data is covered by the Google Privacy Policy.

You may only add a YouTube channel that you own or are authorised to manage. Before a fan page opens, you verify the channel by signing in with the Google account that owns it. fallo reads which channel that account owns once and keeps no access afterwards; see Google and YouTube data.

Acceptable use

fallo only works if inboxes trust it. These rules protect your fans, every other creator, and fallo’s ability to deliver email.

Consent

  • Fans must opt in themselves. Every fan gets a confirm email and only joins your list when they tap it (double opt-in). Don’t sign people up on their behalf.
  • Lists you upload (“Add fans I already have”) may only contain people who asked to hear from you, such as your own newsletter or a sign-up sheet. Each list is reviewed before anything is sent, and each person gets one invite; they only join if they say yes.
  • No bought, rented, borrowed, shared or scraped lists, and no addresses collected for something else.

Sending limits and automatic pauses

  • New channels have daily sending limits (currently 2,000 video emails and 300 confirm emails a day) until fallo marks them as trusted.
  • If too many of your emails bounce or are reported as spam (currently more than 5% hard bounces, or more than 0.3% spam reports, over 7 days), sending pauses automatically until we’ve looked at it.
  • Addresses that bounce or report spam go on a do-not-email list that applies across fallo.
  • We may change these limits at any time to protect deliverability.

Content

fallo may hold any video, or pause any channel, that looks like a scam, phishing, gambling promotion, adult content, hate, malware, or impersonation of another person or brand, while a person checks it. Don’t use fallo to send anything illegal, harmful or deceptive.

Don’t abuse the service

  • Don’t try to get around limits, reviews, the do-not-email list or unsubscribes.
  • Don’t interfere with fallo, probe it for weaknesses, or overload the API beyond its rate limit.
  • Don’t use fallo to collect people’s data for anything other than sending them your videos.

fallo addresses (usernames)

  • Your fallo address is first come, first served, but the real owner of a YouTube handle can claim that name. When a channel is verified, its @handle is offered to it as a fallo address. If someone else holds that name without a verified channel with that handle, they’re moved to a nearby name and told why. If the holder is an active creator with fans, fallo decides.
  • If no YouTube channel is verified for a username within 30 days, we warn you and then release the name.
  • Don’t claim names to sell them, to block someone, or to pretend to be someone else. We may change or take back a name that breaks these terms.
  • When you switch to a new name yourself, links and QR codes using your old one keep working.

Using your fan data

You can see your fans and download them as a CSV file, read them through the API, and send them to other tools with webhooks or Zapier. If you do:

  • Only use fans’ details to send them what they signed up for: your videos and your channel’s content. Don’t sell, rent or share them, and don’t add them to unrelated lists.
  • Honour unsubscribes everywhere. When a fan stops emails on fallo, stop emailing them in any other tool you’ve synced them to as well. The fan.left webhook tells you when this happens.
  • Keep exported data secure and delete it when you no longer need it.
  • You’re responsible for your content and for following the laws that apply to you, such as CAN-SPAM, GDPR and other anti-spam and privacy laws.

Data processing

Your fans join your list. For the emails fallo sends to them on your behalf, fallo processes fans’ personal information for you, to deliver your emails and show you how they did, following these terms and our Privacy Policy.

  • We use fans’ details only to run fallo for you: confirm emails, video emails, stats, and keeping fallo free of spam (including the do-not-email list, which applies across fallo).
  • We use service providers to do this (listed in the Privacy Policy).
  • We don’t sell or rent fans’ addresses, and we don’t show your list to other creators.
  • If a fan asks us to access or delete their information, we’ll handle it and may tell you.
  • Once data leaves fallo through a download, the API, a webhook or Zapier, you control it and you’re responsible for it.

Your content

Your videos, channel name, pictures and other content stay yours. You give fallo permission to read and show them (for example your channel name and picture on your fan page, and your video’s title, description and thumbnail in emails) only to run the service for you. You confirm you have the right to use what you add to fallo.

The fallo name, logo, website and software belong to fallo.

Price

fallo is free for now. We may introduce paid plans or change what the free plan includes. If we do, we’ll tell you by email before any change affects you, and you can download your fan list or delete your account at any time.

Suspension and ending

  • You can stop using fallo at any time, and delete your account in Settings.
  • We may pause, limit, suspend or remove an account, channel, video or name, with or without notice, if we reasonably believe it breaks these terms, puts fans or other creators at risk, or harms fallo’s ability to deliver email. Where we can, we’ll tell you why.
  • We may stop offering fallo altogether. If we do, we’ll give you reasonable notice so you can download your fan list.
  • Sections that by their nature should continue (such as how you may use fan data you’ve downloaded, No warranty, Liability and Governing law) still apply after your account ends.

No warranty

fallo is provided “as is” and “as available”. We work hard to send every video quickly, but we don’t promise that fallo will always be available, error-free, or that every email will arrive, be opened, or avoid spam folders. YouTube, Google and email providers can change in ways we can’t control. To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and non-infringement.

Limitation of liability

To the extent the law allows, fallo won’t be liable for any indirect, incidental, special or consequential losses, or for lost profits, revenue, views, fans or data. Our total liability for any claim about fallo is limited to the greater of what you paid us in the 12 months before the claim and [liability cap, e.g. US$100].

Nothing in these terms limits liability that can’t be limited by law.

Changes to these terms

We may update these terms. We’ll change the date at the top, and if a change is significant we’ll email creators before it takes effect. If you keep using fallo after that, you accept the new terms; if you don’t agree, you can delete your account.

Governing law

These terms are governed by [governing law / courts]. If any part of them can’t be enforced, the rest still applies. If we don’t enforce a term straight away, we haven’t given up the right to do so later.
